UUhat Focus – Photography Terms of Service

1. Parties

This agreement is between Shane Stokes, trading as Uuhat Focus (ABN: 91349807584) ("Photographer"), and the individual or entity who books photography services ("Client"). The Photographer is based in Brisbane, Queensland, Australia.

2. Booking & Payment

• A 25% non-refundable deposit is required to secure your booking.

• Final payment is due upon gallery delivery.

• Payment methods accepted: bank transfer or other agreed method.

• No images (digital or printed) will be released until the balance is paid in full.

3. Services Provided

The Photographer agrees to provide photography services as discussed at the time of booking. This may include (but is not limited to): events, portraiture, automotive, nature, or drone photography. Details of session duration, number of images, or location will be confirmed per job.

4. Image Delivery

• Preview images will be delivered within 1–2 weeks of the shoot.

• Final edited galleries are typically delivered via private online link.

• The gallery will remain accessible for a limited time (unless otherwise agreed).

• Only low-resolution previews will be visible until final payment is received.

5. Copyright & Usage

• All images remain the copyright of Shane Stokes (Uuhat Focus) under the Copyright Act 1968 (Cth).

• The Client is granted a personal-use licence only.

• Commercial use, resale, or distribution is not permitted unless agreed in writing before the shoot.

• The Photographer may use selected images for promotional purposes (e.g. website, social media, portfolio), unless the Client requests otherwise in writing before the shoot.

6. Cancellations & Rescheduling

• Deposits are non-refundable.

• If the Client cancels within 72 hours of the scheduled shoot, a further fee may be payable at the Photographer’s discretion.

• If the Photographer is unable to attend due to illness, emergency, or force majeure, a full refund or reschedule will be offered.

7. Client Responsibilities

• The Client must ensure access to the location, obtain any required permissions, and provide accurate event details.

• For events involving other individuals (e.g. children, guests), the Client is responsible for ensuring participants are aware they may be photographed.

8. Liability

• While every effort will be made to deliver high-quality images, the Photographer is not liable for factors outside their control, including but not limited to: weather, lighting conditions, or uncooperative subjects.

• The Photographer’s total liability is limited to the amount paid under this agreement.

• The Photographer is not liable for unauthorised downloads, screenshots, or third-party misuse of images once delivered.

9. Governing Law

This agreement is governed by the laws of Queensland, Australia.
Any disputes will be handled through good-faith negotiation first, and if unresolved, through appropriate Queensland dispute resolution channels.

10. Agreement

By booking and paying the deposit, the Client agrees to these Terms of Service.
